This promotion (the "Sweepstakes") is sponsored by Windstar Cruises, LLC, 2101 4th Avenue, Suite 210, Seattle, WA 98121 (“Windstar” or “Windstar Cruises”).
 
ENTRY
NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES.  Purchase will not improve your chances of winning. To enter, submit your email address at the sweepstakes registration page at http://windstarsurveys.polldaddy.com/s/windstar-cruises-spring-2017-itinerary-survey (the “Registration Page”). By participating in the Sweepstakes, you are providing data to Windstar Cruises and Xanterra Parks & Resorts, Inc. and other entities affiliated with Windstar Cruises to use for marketing and product development purposes. You will receive emails for special offers and you may unsubscribe from these promotional emails at any time. Multiple entries are automatically disqualified; only the first entry will be considered.
 
ELIGIBILITY
The Sweepstakes is open to all legal residents of the 50 United States and the District of Columbia who are twenty-one (21) years of age or older as of April 29, 2017, excluding Hawaii. Employees (and immediate family members and household members of employees) of Windstar Cruises and  Xanterra Parks & Resorts, Inc. and their affiliates, assigns, advertising, promotional and fulfillment agents, attorneys, and other representatives (and their immediate family members and household members) and the persons with whom each of the above are domiciled are not eligible. This offer is void in Hawaii and wherever prohibited or restricted by law. Each entrant in the Sweepstakes must be the rightful holder of the email account submitted at entry. In the event of a dispute concerning the identity of the holder of the email account, the holder will be deemed to be the person who owns the email address according to the records of the email service provider. The email account must be opened prior to the commencement of the Sweepstakes.
 
ENTRY PERIOD
The Sweepstakes will commence on April 29, 2017 at 9:00 a.m. (ET) and the last entry will be accepted no later than May 20, 2017 at 11:59 p.m. (ET) (the “Entry Period”). Windstar’s computer shall be the official clock of the Sweepstakes.
 
SELECTION AND NOTIFICATION OF WINNERS
One (1) potential winner will be selected by a random drawing from among the eligible entries received during the Entry Period. Potential winners will be chosen by Windstar Cruises no later than May 30, 2017. Potential winners will be notified by email no later than May 30, 2017 and required to execute and return an Affidavit of Eligibility and Release, including, where permitted, a publicity release (the “Affidavit”) and a release of liability and, where permitted, publicity (the “Release”) from their guest. If a potential winner does not return the Affidavit and Release within 7 days of delivery, the prize will be deemed forfeited and an alternate winner will be chosen. Return of any prize notification as undeliverable will result in disqualification and selection of an alternate winner.  If winner cannot or will not accept the prize, the prize will be forfeited and an alternate winner may be selected. Alternate winners will be chosen by a random drawing from among the remaining eligible entries.
 
PRIZE 
One (1) Grand Prize winner will receive a trip for two (2) people on a 7-day Windstar itinerary based on the winner’s selection and availability and restricted to Category B staterooms only (the “Cruise”). Included in the prize is: (1) regular onboard meals for winner and one guest (excluding mandatory onboard gratuities, ground transportation, discretionary dining charges, meals in alternate dining venues, alcoholic beverages, wine, and/or specialty coffee drinks); (2) regular onboard entertainment for winner and one guest; (3) one standard, double-occupancy stateroom; (4) roundtrip airfare from selected US airports for winner and one guest from airport nearest winner’s home (or if winner resides within a 100-mile radius of the embarkation point of the Cruise, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for any difference in prize value), subject to the terms and conditions below; and (5) port fees and taxes. Not included in the cost are ground transportation, checked baggage fees, alcohol, shore excursions, and any purchased onboard amenities, hotels, pre or post cruise excursions and transfers to or from the ship, and other incidentals and expenses not specified. Estimated retail value of this prize is up to $12,000. Winner(s) should contact Windstar at contest@windstarcruises.com to book the Cruise.
 
 
FINAL DECISION REGARDING THE PRIZE AWARDED WILL BE MADE BY WINDSTAR CRUISES BASED ON AVAILABILITY. JUDGES’ DECISIONS ARE FINAL AND BINDING. THE ODDS OF WINNING DEPEND UPON THE NUMBER OF ENTRIES RECEIVED.
 
 
Restrictions
  • All travel arrangements are subject to availability, blackout dates and other restrictions. Reservations must be confirmed at least (90) days prior to intended date of departure and are subject to availability at time of request. Prize travel must be completed by Winner and guest must travel on same itinerary throughout. Rebooking and changes are not permitted. Tickets are non-refundable and non-transferable. All unspecified expenses related to acceptance/use of prize and, except as expressly provided herein, all taxes on prize are winner’s sole responsibility. Winner and guest must depart from one of Windstar’s US gateway airports: Los Angeles International Airport (LAX), John F. Kennedy International Airport (JFK) or George Bush Intercontinental Houston Airport (IAH).
 
  • No prize substitution or cash redemption is allowed, except by Windstar, in its sole discretion, if advertised prize is unavailable and only then for prize of equal or lesser value. No prize transfers are allowed.
 
  • Limit one entry per person/household/per email address. Windstar reserves the right to disqualify any person or email address that submits more than one entry regardless of entry method. Incomplete entries, or those containing incorrect information, will be voided. Proof of sending or submission will not be deemed to be proof of delivery or receipt by Windstar. Use of any automated system or third-party software or website to submit entries is prohibited and will result in disqualification of all such entries as well as the entrant. Windstar reserves the right to void all entries made through any robotic, automatic, mechanical, programmed or similar entry duplication method and to disqualify any individual using such a method and to disqualify any person or e-mail address that submits more than maximum allowed entries. All entries become the exclusive property of Windstar and will not be acknowledged or returned and no correspondence will be entered into by Windstar regarding the status of an entry.
 
Terms and Conditions of Prize
 
All prize details not specified in the Official Rules will be determined in Windstar Cruises’ sole and absolute discretion. Prize includes all applicable government fees and taxes for the Cruise and airfare only. Winner and guest are responsible for all other taxes, including income taxes on prize.  Cruise must be completed by December 31, 2018 or the prize will be forfeited.
 
Except as expressly provided herein, Winner is solely responsible for any and all expenses and incidental travel costs not expressly stated in the prize description herein; including, but not limited to, all ground transportation, shore excursions fees, discretionary hotel and dining charges, mandatory onboard gratuities, meals in alternate dining venues, alcoholic beverages, boutique purchases, travel upgrades and any other personal incidental costs or other expenses not specifically set forth herein.
 
All reservations and air and cruise arrangements including, without limitation, the dates and times are at the sole discretion of Windstar Cruises. Cruise must be taken by December 31, 2018; no alternative cruise dates are available or Prize will be forfeited, except that, if Windstar Cruises cancels the selected Cruise, Windstar Cruises will issue the Winner credit for a comparable cruise and airfare to be taken within the following 12 months. All prize details are subject to availability and restrictions such as blackout dates, including holidays, may apply. The winner’s guest must be 21 years of age or older as of the date of departure, unless the guest is the Winner’s minor child. Minors must be accompanied at all times during trip (including, but not limited to, cruise travel, cruise activities and all other prize-related events) by minor’s parent. Winner and guest must cruise on same itinerary. Cruise guest must (or a guest’s parent if guest is an eligible minor in his/her state/province of residence) sign and return a cruise liability/publicity (where permitted) release before any ticketing of Cruise occurs. The Winner and guest must have all necessary identification and/or cruise documents (including, but not limited to, a valid U.S. driver’s license, valid passport, visa (if applicable), and all other necessary travel documents) required for Cruise. Once the guest is selected, he/she may not be substituted, except in Windstar’s sole and absolute discretion. Cruise is subject to the terms and conditions of the Windstar passage contract. As set forth in more detail in the passage contract, Windstar reserves the right to refuse to embark Winner or any guest, at any time if, in the sole opinion of Windstar, Winner or guest, or any minor or other person in Winner or guest’s care during the Cruise, is unfit for any reason for the Cruise. Windstar Cruises shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by Cruise operators or any other persons providing any prize-related services or accommodations. Winner and guest are also responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Windstar Cruises has not, and will not, obtain or provide travel insurance or any other form of insurance. Lost, stolen or damaged Cruise tickets, travel vouchers or certificates will not be replaced or exchanged. If unclaimed, the prize will not be re-awarded. Additional prize award details and travel information will be provided to the prize winner at the time of notification.
 
BY ACCEPTING PRIZE, WINNER ACCEPTS (AND AGREES TO CONFIRM IN WRITING) THE INHERENTLY DANGEROUS NATURE AND RISK IN AIR, LAND AND SEA TRAVEL, INCLUDING PERSONAL INJURY AND/OR DEATH, ACKNOWLEDGES THAT HIS/HER PARTICIPATION IN THE PRIZE EVENT IS VOLUNTARY, ACKNOWLEDGES THAT THERE ARE NATURAL FACTORS AND OCCURRENCES WHICH MAY IMPACT ON OR AFFECT THE SAFETY OF THE ACTIVITIES HE/SHE IS PARTICIPATING IN AND HE/SHE ASSUMES THE RISK OF SUCH FACTORS AND OCCURRENCES AND AGREES TO THE EXTENT ALLOWED BY LAW THAT PROMOTIONAL PARTIES (DEFINED HEREIN) SHALL NOT BE IN ANY WAY RESPONSIBLE FOR ANY RESULTING INJURY AND/OR DEATH.
 
The estimated retail value of Prize: Up to $12,000 USD plus value of the included air travel.  Actual value of the Prize may vary based on cruise fare and airfare fluctuations. Any difference between the stated approximate retail value and the actual value of the Prize will not be awarded. 
 
The prize will be awarded, provided there is at least one (1) eligible entry. Prize is non-transferable and cannot be sold or, except at the sole discretion of Windstar, redeemed for cash. In the event that a prize is unavailable, Windstar Cruises reserves the right to substitute a cash payment of equal or greater value.
 
Except as expressly provided herein, winner is solely responsible for all federal, state and/or local taxes (including but not limited to income taxes on the prize) and for any other fees or costs associated with the prize they receive, regardless of whether it, in whole or in part, is used, excluding Cruise taxes and air travel taxes provided by Windstar.
 
CONDITIONS
By participating, Sweepstakes entrants affirm that they have read these Official Rules and Terms and Conditions of Prize, agree to be bound by them and the selection of the winner, which shall be final, and waive any right to claim ambiguity in the Sweepstakes and/or these Official Rules and Terms and Conditions. Windstar’s failure to enforce any term of these Official Rules shall not constitute a waiver of that term. Acceptance of prizes constitutes permission to use the winner's name, voice, likeness, biography, and prize won for purposes of advertising, promotion, marketing and publicity without additional notice or compensation, except where prohibited or restricted by law.
 
As a condition of entering, Sweepstakes entrants agree (and agree to confirm in writing): (a) to release Windstar Cruises and Xanterra Parks & Resorts, Inc. and their affiliates, subsidiaries, retailers, sales representatives, advertising, promotion and fulfillment agencies, distributors, and each of their officers, directors, employees and agents (collectively, the “Released Parties”), from any and all liability, loss or damage incurred with respect to the awarding, receipt, possession, and/or use or misuse of any prize, including any traveling related thereto (b) under no circumstances will entrant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of, or connected with, this Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments and award shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees and court costs.
 
Sweepstakes entrants hereby release, discharge, and hold harmless the Released Parties from any and all liability or damages arising from the administration of the Sweepstakes and the use or misuse of any prize received in this Sweepstakes, including, without limitation, the following: (i) late, lost, incomplete, delayed, misdirected or unintelligible entries, (ii) any printing, typographical, administrative or technological errors in any materials associated with the Sweepstakes, (iii) any damage to the entrant's or any third party’s computer, related equipment, data files, and software resulting from entrant's completing the survey, downloading of information regarding the Sweepstakes or participation in the Sweepstakes; (iv) telephone, computer, hardware, software, satellite, programming or interrupted or unavailable network, server or other connections, network malfunction, or other technical failures or errors, or failure to properly process surveys or entries; (v) communication disruption or other forces beyond the reasonable control of Windstar, including inability to access the Registration Page, submit entries or other disruption related to Internet traffic, virus, bug, or nonauthorized intervention.
 
Except as provided above, Windstar Cruises and Xanterra Parks & Resorts, Inc. may only use the personally identifiable information obtained from the entrants in accordance with their respective privacy policies, which may be found at http://www.windstarcruises.com/PrivacyPolicy.aspx , and

Windstar Cruises reserves the right, in its sole discretion, to modify, cancel or suspend this Sweepstakes and an unawarded prize remaining at the time of modification or suspension shall be awarded to eligible non-winning participations selected by random drawing conducted from among all eligible non-winning entries unaffected by technical failures and received prior to the action should a virus, bug, computer problem or other cause beyond Windstar’s control corrupt the administration, security or proper operation of the Sweepstakes or if, for any reason, the Sweepstakes is not capable of running as planned by reason of, but not limited to, tampering, unauthorized intervention, fraud, technical failures or any other causes which Sponsor deems could corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes. In the event of the foregoing, Windstar shall post notice of such action on the Registration Page. Windstar Cruises may prohibit an entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that he/she is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking or employing other unfair practices or by abusing other entrants or the representatives of Windstar Cruises and Xanterra Parks & Resorts, Inc. or their affiliates.  
 
ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND, IN SUCH EVENT, WINDSTAR CRUISES RESERVES THE RIGHT TO PURSUE ITS REMEDIES AND DAMAGES (INCLUDING COSTS AND ATTORNEY'S FEES) TO THE FULLEST EXTENT OF THE LAW.
 
Any disputes, claims and causes of action arising from the Sweepstakes or any prize awarded (collectively, “Claims”) will be determined according to the laws of the State of Washington, without reference to its conflict of laws principles, and the entrants consent to the personal jurisdiction of the State and Federal Courts located in the State of Washington over them and agree that such courts have exclusive jurisdiction over all such disputes. Claims shall be resolved individually, without resort to any form of class action, and exclusively by the State and Federal Courts located in the State of Washington; any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

Tahiti Air and Hotel Included

Taxes, Fees & Port Expenses are additional and range from ($94-$124 per person). Flights for Air + Hotel package are between LAX and Papeete. Flights arriving in Papeete on the evening before embarkation day include one night pre-cruise hotel in Papeete. Flights leave from Papeete on the evening of disembarkation day. Deviations to this flight schedule are not permitted. Offer includes a post-cruise day-room in Papeete, as well as transfers to and from the yacht and airport. Hotel accommodations for package are per booked stateroom or suite, are for published hotel or similar property, are applicable on select cruises, and includes all tips, gratuities, taxes, and luggage-handling fees associated with the hotel. WINDSTAR PRICE ASSURANCE POLICY

Terms & Conditions

Guests who purchase a cruise on Windstar will be eligible for reimbursement upon request if the fare published by Windstar for their specific departure and cabin class is reduced after they have made a booking and deposit, and if the request is received by Windstar at least 7 days prior to sailing.  The reimbursement will be provided in the form of a shipboard credit, upgrade, fare reduction, or a future cruise credit.  Windstar will determine the form of reimbursement, and the amount of reimbursement will be the difference between the fare actually paid by the guest and the published fare on WindstarCruises.com the day the request is received.  Guests who select reimbursement will be eligible for any complimentary inclusive features (e.g., hotels, air, tours) associated with the new fare and will forfeit any complimentary inclusive features associated with the original fare.  All requests for reimbursement must be made directly to Windstar Cruises at 1-800-258-7245 (during regular reservations hours) at least seven (7) days prior to sailing.  Windstar’s new fare pricing assurance policy will take effect with new bookings made on or after June 27, 2016. Windstar reserves the right to modify or terminate this policy at any time for bookings not yet made.

GENERAL CRUISE TERMS & CONDITIONS

All itineraries, schedules, and ports are correct at time of publication but are subject to change without notice. “Windstar Cruises,” “We,” and “Us” refer to Windstar Cruises LLC, a Limited Liability Company that acts as the agent of Owner and is doing business as Windstar Cruises. Due to the small size and intimate nature of our yachts, Windstar Cruises is unable to accommodate children under eight (8) years of age. Guests under 21 years of age must be accompanied by a parent, guardian or chaperone in their stateroom or suite who is at least 25 years old; one adult (age 25 or older) chaperone is required for every five (5) people under 21.

PASSAGE CONTRACT:  All cruises are provided subject to the terms of the Windstar Passage Contract. 

 

CRUISE FARES: Your fare includes ocean transportation, stateroom or suite accommodations, and all meals and entertainment on board the yacht. Not included, however, are items of a personal nature, such as alcoholic beverages, laundry, transfers prior to or after your cruise, or optional programs or activities. Shore excursions and airfare are available for an additional charge. All rates shown are per person based on double occupancy. Fares are published in U.S. dollars (USD).
 
Note: Third-person rates are available upon request. For further information on fares, nondiscountable amounts, taxes, and surcharges, please see below.
 
SINGLES: Single occupancy of a stateroom is generally 175 % of the published per person stateroom cruise fare (200 % of the Owner’s Suite, Suites, and Bridge Suites per person cruise fares) and is subject to availability.
 
WINDSTAR FARE PRICE ASSURANCE POLICY: Guests who purchase a cruise on Windstar will be eligible for reimbursement upon request if the fare published by Windstar for their specific departure and cabin class is reduced after they have made a booking and deposit, and if the request is received by Windstar at least seven (7) days prior to sailing. The reimbursement will be provided in the form of a shipboard credit, upgrade, fare reduction, or a future cruise credit. Windstar reserves the right to modify or terminate this policy at any time for bookings not yet made.
 
RESERVATIONS AND PAYMENT: Windstar Cruises works with travel agencies worldwide to serve your needs. Reservations either made by or assigned to a travel professional must be managed by the agency of record. While Windstar is unable to provide specific booking information on agency bookings, we are happy to answer general questions. Alternately, you may reserve your cruise directly with us if you prefer. Since accommodations are limited by the number of staterooms or suites on each yacht, reservations should be made as early as possible. Payment for your Windstar cruise is to be paid to the travel agency with which you made your reservation, or to Windstar Cruises directly. Travel documents will be issued when full payment has been received by Windstar Cruises. Refunds for cancelled or unused services will be made, less any applicable cancellation fees and charges. If you have reserved your cruise with your travel professional, please be aware that additional cancellation fees charged by the booking agency may apply.
 
DEPOSIT AND FINAL PAYMENT REQUIREMENTS: Deposit of 15 % of cruise fare, hotel, and non-discountable amounts is required within three (3) days of booking to secure a reservation. Final payment is due prior to 120 days before departure date. Your travel documents are usually received approximately 60 days prior to departure. If booking directly with Windstar Cruises send payments to Windstar Cruises, 2101 4th Avenue, Suite 210, Seattle, WA 98121, U.S.A. Payment is also welcome by American Express®, Discover Card®, Visa®, or MasterCard®. For faster processing, please include your confirmation number on your check. All charges are in USD. Windstar is not liable for any currency exchange rate or foreign exchange fee imposed by the bank or credit card company. Payment of the cruise deposit and Travel Protection Plan (if applicable) constitutes a binding of the Terms & Conditions.
 
LATE BOOKING POLICY: On bookings within 45 days of departure, Windstar Cruises requires final payment (cashier’s check, electronic transfer of funds, or American Express®, Discover Card®, Visa®, or MasterCard®) before we can initiate the process of requesting hotel and/or air space; on bookings within 14 days of departure, we are unable to make air or hotel transfers or arrangements. Windstar Cruises will advise you of the status of the request within five (5) working days of receipt of final payment. If your request is confirmed, electronic tickets will be sent via email. If we are unable to confirm your late booking all monies paid will be refunded in full. Please note, changes or additions to the cruise package (i.e. transfers, special services, gifts, or onboard packages) cannot be made within seven (7) days of departure and should be arranged once you are on board the yacht.
 
CANCELLATION POLICY:
Each booking cancelled before 120 days prior to initial departure will be subject to a $50 per person cancellation fee. A full refund (except for the amounts paid for Cancellation Protection Plan and the $50 per person fee) will be made for written cancellations received by Windstar Cruises at least 121 days prior to the date on which you are to commence travel by any mode of transportation booked through Windstar Cruises (air, sea, or land). Guests who cancel after that date for any reason, including medical or family reasons, are subject to the following cancellation fee schedule:
*  120-90 days before commencing travel  – 15% of gross fare (deposit);
*   89-60 days before commencing travel  – 35% of gross fare;
*   59-30 days before commencing travel  –  50% of gross fare; 
*   29-0 days before commencing travel  –  100% of gross fare.
 
Windstar Cruises can only be responsible for refunding amounts actually received. Travel agencies may impose their own cancellation fees. Agency fees of any nature are a matter to be decided on solely by the agency and guests. Windstar Cruises passenger contracts are non-transferable. Name changes and departure date changes are considered reservation cancellations/re-bookings and are subject to cancellation fees. Changes require the prior approval of Windstar Cruises and may not always be possible. Windstar Cruises cruise and accommodations cancellation Terms & Conditions do not apply to airfare reservations.
 
CHANGE FEES: Changing your itinerary after reservations have been made can result in a loss of advantages gained by early planning. To cover administrative costs, a minimum charge of $35 per person will be assessed if you request a change in your travel arrangements less than 121 days prior to commencement of travel. This doesn’t apply to departure date changes made by Windstar Cruises. Change fees are not assessed for stateroom upgrades or for the addition of services unless air reservations are altered and/or travel documents must be reissued.
 
CRUISE CONDITIONS: “Yacht” refers to the yacht that will provide the ocean transportation portion of the cruise. “Cruise” refers to the specific cruise indicated, as it may be modified by us, and shall include periods during which you are embarking or disembarking the yacht or are on shore while the yacht is in port. “Initial Departure” means the time at which you first begin transit by any means of transport booked by us (including air transportation) for the purpose of taking the cruise. “Windstar Cruises Air Package” refers to air transportation booked for you by Windstar Cruises to enable you to travel to and from your cruise.
 
NON-WINDSTAR CRUISES SERVICES: These include non-Windstar Cruises Services such as airlines and other off-ship transportation carriers, shore excursions, and accommodations. Non-Windstar Cruises Services are solely at your risk and subject to the terms or arrangements made by you. Windstar Cruises assumes no responsibility with respect to these non-Windstar Cruises Services including delay, injury, death or damage to property. Situations may arise that, in the opinion of Windstar Cruises, make it necessary for Windstar Cruises to cancel, advance, or postpone a scheduled departure, change itineraries or make substitutions involving ports of call, other travel components, vessels, or other modes of transportation. These situations may include, by way of example, concerns regarding weather conditions, issues involving safety matters, alternative business arrangements or charters resulting in the decision to withdraw a cruise from public sale, or requirements of governmental authorities. If this should occur, Windstar Cruises does not assume responsibility or liability for any losses, inconvenience, or expenses incurred by guests as a result.
 
GUESTS WITH DISABILITIES: Windstar Cruises does not discriminate against persons on the basis of disability. We seek, to the extent feasible, to accommodate the needs of persons with disabilities. There are no elevators on Wind Star and Wind Spirit nor were the yachts originally constructed to be wheelchair accessible. As a result, these two yachts may be unsuitable for people relying solely on mobility devices. Wind Surf, Star Pride, Star Legend, and Star Breeze are equipped with elevators, although some of the passenger common areas are not wheelchair accessible. Staterooms on Wind Surf are not wheelchair accessible. Four (4) suites on the all- suite yachts provide limited access for wheelchairs. Also note, there is no elevator access to board the yachts. Certain ports require the yacht to anchor; in this case guests must be ferried into port by using a gangplank to board a tender. Service animals are permitted on board yachts if prior arrangements have been made at time of booking. In limited situations where an individual with a disability would be unable to satisfy certain specified safety and other criteria, even when provided with appropriate auxiliary aids and services, we may find it necessary to ask the individual to make alternative travel arrangements. It is essential that Windstar Cruises is notified of any special medical, physical, or other requirements you may have at time of booking.
 
FARES, NON-DISCOUNTABLE AMOUNTS, GRATUITIES, TAXES, FEES, PORT EXPENSES, AND SURCHARGES: Windstar Cruises reserves the right not to honor any published prices that it determines were erroneous due to printing, electronic, or clerical error. Each cruise fare includes a Non-Discountable Amount. That portion of the fare is both non-commissionable to travel professionals and not subject to reduction in the event of a percentage discount promotion, 2-for-1 promotion, or otherwise. If cost factors dictate the need for fare increases, Windstar Cruises may do so at any time prior to departure. Guests can cancel (without paying a cancellation fee) rather than accept a fare increase. Mandatory onboard gratuities are extra.

 

Taxes, Fees & Port Expenses, as used by us, may include, without limitation, all or a portion of all fees, charges, tolls and taxes imposed on us by governmental or quasi-governmental authorities, as well as third party fees and charges arising from a vessel's presence in a harbor or port. Taxes, Fees & Port Expenses may include U.S. Customs fees, head taxes, Panama Canal or other canal tolls, passenger facilities charges, dockage fees, wharfage fees, inspection fees, pilotage, air taxes, hotel or VAT taxes incurred as part of a land tour, immigration and naturalization fees, and Internal Revenue Service fees, as well as fees for navigation, berthing, stevedoring, baggage handling/storage and security services. Taxes, Fees & Port Expenses may be assessed per passenger, per berth, per ton or per vessel. Assessments calculated on a per ton or per vessel basis will be spread over the number of passengers on the Ship. Taxes, Fees & Port Expenses are subject to change and we reserve the right to collect any increases in effect at the time of sailing even if the fare has already been paid in full. Windstar Cruises reserves the right to impose or pass through fuel surcharges, security surcharges, or similar incidental surcharges. No right of cancellation exists under these circumstances.
 
YACHTS' REGISTRY AND TRADEMARKS: All of Windstar Cruises yachts are registered in the Bahamas and owned by Bahamian entities. “Owner” refers to the owner of the yacht; Wind Spirit is owned by Wind Spirit Limited; Wind Star is owned by Wind Star Limited; Wind Surf is owned by Degrees Limited; and Star Pride is owned by Windstar Pride Limited. Star Breeze is owned by Star Breeze Limited and Star Legend is owned by Star Legend Limited. Yacht ownership and registry are subject to change. Windstar Cruises has registered trademarks in the United States and various foreign countries for the names and phrases Windstar®, 180° from Ordinary®, 180 Degrees from Ordinary®, Romance Under Sail®, and the Windstar Cruises logo.
 
TRANSFERS/PRE- & POST-CRUISE SERVICES: Services for Windstar Cruises cruise-only guests (individuals who do not purchase air transportation or cruise extensions from Windstar Cruises) begin with embarkation at the noted time in your cruise documents. Any transfers, meals, and dayroom accommodations required prior to this time are the responsibility of the guest. Please make a note of this, as many international flights arrive several hours prior to the scheduled embarkation time. Guests may purchase a transfer from local airport to yacht for day of cruising and from yacht to local airport for day of disembarkation directly through Windstar Cruises Vacation Planning. Guests flying on dates other than the date of (dis)embarkation must arrange their own transfers unless the reason for the different date is because of the purchase of a cruise extension from Windstar Cruises. Transfers for these guests will be arranged between airport, hotel, and pier, as appropriate, so long as the transfer dates coincide with the dates of the services purchased from Windstar Cruises.
 
SHIPBOARD ACCOUNT AND CURRENCY EXCHANGE: Our cashless society is designed to make your life on board as simple as possible. When you board the yacht, your account has already been activated and you may make purchases by simply showing your guest identification card and signing a receipt. On embarkation day, you will need to register your credit card (Visa®, Discover®, MasterCard®, or American Express®) in order to use your onboard account for shipboard purchases. We do not accept debit cards or prepaid cards. Your card will be pre-authorized for USD $60 per person for each day of your cruise. At the end of your cruise, you will receive a final statement, and your card will be charged only for the actual amount of your purchases.
 
Please inform your credit card issuer in advance that your card will be used on a Windstar yacht. This wil help prevent delays in obtaining pre-authorization on board. Products and services on board are in USD. Windstar is not liable for any foreign exchange fees imposed by your card issuer. There are no currency exchange services offered on board.
 
AIR PROGRAM
FORCED OVERNIGHTS: Due to airline schedules (and occasionally, lack of flight availability), travel between many major cities and your cruise may require one (1) or more hotel overnights en route. If necessary, the cost of this hotel accommodation is not included in the airfare and is the responsibility of the guest. Hotels will be selected by Windstar Cruises and may not be at the port. Guests are responsible for meals and items of a personal nature.
 
Note: Some hotel packages may not be available in conjunction with our air/sea program due to our preferred carrier’s flight frequency between port cities and the U.S.A. or Canada.
 
SEAT ASSIGNMENTS/AIRLINE SERVICE REQUESTS: While seat assignments, frequent flyer miles, or other service requests such as wheelchairs, special meals, or oxygen cannot be guaranteed by Windstar Cruises, your travel professional or Vacation Planner may assist you with these arrangements, where possible, once you receive your tickets. Some airlines or charter operations may not offer advance seat assignments. Each airline has its own baggage allowance policy. You are responsible for any excess baggage charges imposed by airlines.
 
CUSTOM AIR SERVICE: Windstar Cruises offers services in making air arrangements to and from our cruises. All requests are subject to availability and are not guaranteed. If confirmation is possible, guests will be assessed a non-refundable service charge per request and any additional airline costs incurred.
 
AIR CHANGES, CANCELLATIONS, AND REFUNDS: Once airline tickets have been issued, any changes or cancellations will be assessed a $50 per change, per ticket fee, in addition to fees imposed by the airline carrier. Published and consolidator fares are non-refundable once ticketed. Your Vacation Planner will discuss the terms of your ticket with you prior to purchase. Should the change or cancellation requested result in a fare increase or airline-imposed fee, you will be solely responsible for payment of the additional amount. The maximum refund for unused flights will not exceed the air add-on paid by you to Windstar Cruises. Please note, that because of changing airline tariffs, your actual air tickets may reflect fares higher or lower than the charge assessed by Windstar Cruises. If so, the difference is neither chargeable nor refundable to you.
 
LIABILITY AND RELATION WITH AIRLINES: If, due to any cause beyond our control (including, for example, capacity controls placed upon us by airlines due to the types of fares under which we book), we are unable to arrange for air transportation or the air transportation we arrange is unavailable or otherwise fails to materialize, our sole liability will be limited to refunding the air add-on amount paid to us. We assume no liability for any acts or omissions of any airline, including, without limitation, those involving cancellation of flights, schedule changes, re-routings, damage to or delay or loss of baggage, flight delays, equipment failures, accidents, pilot or other staff shortages, overbooking, or computer errors. The liabilities and obligations of an airline to you and your rights against an airline are subject to any and all terms and conditions of the airline’s ticket and tariffs and any and all governmental laws and regulations bearing upon or otherwise relating to such rights, liabilities, and obligations.
 
AIR TAXES AND FEES: Air add-on costs quoted by Windstar Cruises will not include passenger facility charges, federal flight segment taxes for each flight segment (takeoff and landing), the September 11 security fee per passenger enplanement, international arrival and departure taxes assessed in foreign countries (the amount of which may be charged in the currency of the foreign country and is subject to change), or new taxes which may be enacted after this information was published.

You agree that no bond or other security shall be required in connection with such injunction.

17. MISCELLANEOUS TERMS

This site is controlled and operated by Windstar from its offices within the State of Washington, United States of America. Windstar makes no representation that materials in the site are appropriate or available for use in other locations. These terms shall be governed by and construed in accordance with the laws of the State of Washington, without giving effect to any principles of conflicts of law. You agree that any action at law or in equity arising out of or relating to these terms shall be filed only in the state or federal courts located in Seattle, King County, Washington and you hereby consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.

Your being permitted to use this site will not be construed as creating any joint venture, partnership, employment or agency relationship between you and Windstar.

If any provision of these terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of any remaining provisions.

This is the entire agreement between you and us relating to the subject matter herein and cannot be modified except in writing, signed by both you and us.

In the event of litigation involving the use of this site, the prevailing party will be entitled to recover its reasonable attorneys fees and costs.
